Terms of Service (DRAFT)
These Terms govern use of Thavana (the “Service”), a loan and collection management software platform provided by Twincord Technologies Pvt. Ltd. (“Provider”).
1. Roles of the parties
- Twincord Technologies Pvt. Ltd. is the software provider and, for personal data entered by customers, a data processor.
- The finance company or money lender that registers on Thavana (the “Tenant”) is the data fiduciary for its borrowers’ and staff data and decides the purposes of processing.
2. Tenant responsibility for lending and compliance
The Tenant is solely responsible for its lending activities, including licensing and registration, interest rates and charges, KYC, loan agreements, collection practices, record keeping, taxation, and compliance with all applicable laws, including RBI directions, the Tamil Nadu Money Lenders Act and any other state or central law. The Provider does not lend money, does not advise on lending, and is not a party to any loan between a Tenant and its borrowers.
3. Accounts and trial
New Tenants receive a 14-day trial. The Tenant is responsible for activity under its user accounts and for keeping credentials confidential.
4. Acceptable use
The Service must not be used for unlawful, abusive or harassing collection practices, or to attempt access to another Tenant’s data.
5. Data protection
Processing of personal data is described in the Privacy Policy and is subject to India’s Digital Personal Data Protection Act, 2023 (“DPDP Act”).
